Welcome to EnergyChain (energychain.ca). By accessing or using our platform, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.
2. Scope of Service
EnergyChain provides a platform for decentralized asset tokenization, smart contracts, and energy-based transactions through its Enterprise Resource Planning (ERP) system. The services offered include the creation, management, and execution of tokenized energy projects and contracts, subject to the following terms:
3. ERP Service Fees and Costs
EnergyChain operates as an ERP service, enabling users to tokenize assets, manage contracts, and handle appraisals. The use of this service incurs specific fees based on the value and complexity of the project, which may include:
- Smart contract creation and management
- Asset tokenization
- Data aggregation, appraisals, and evaluations
Important: ERP service fees are non-refundable, even in the event of project rejection or service disruptions. All fees are clearly stated and must be agreed upon before using the service.
4. System Downtime and Data Loss
While EnergyChain strives to provide uninterrupted service, occasional system downtimes may occur due to scheduled maintenance, unforeseen outages, or updates. EnergyChain is not liable for any loss of data, transactions, or functionality during such downtimes.
Users are encouraged to maintain backups of all relevant data, as EnergyChain is not responsible for:
- Lost data due to server outages or maintenance
- Delays caused by technical failures or disruptions
- Corrupted or lost transactions
5. Investment Disclaimer
The use of EnergyChain for tokenizing assets or participating in smart contract ventures does not constitute an investment offer or financial advice. All users must perform their own due diligence regarding any potential project risks. Tokenization through EnergyChain does not guarantee returns, profits, or appreciation in token value.
EnergyChain does not offer guarantees on future project success, and all transactions are executed at the user's own risk. Past performance or the appearance of profitability should not be viewed as an indicator of future success.
6. Save Harmless
By using EnergyChain, you agree to indemnify and hold harmless EnergyChain, its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of your use of the platform or any violation of these Terms and Conditions.
This includes, but is not limited to:
- Financial losses due to failed tokenization or contract disputes
- Inaccurate or incomplete project data
- Loss of digital assets or data
7. No Partnership or Employment Relationship
Unless explicitly stated in a written contract, the use of EnergyChain does not create an employment relationship, partnership, joint venture, or any other legal relationship between EnergyChain and its users.
EnergyChain acts solely as a platform for executing services related to energy asset tokenization, contract management, and related functions.
8. Intellectual Property
All content, trademarks, and software on EnergyChain, including logos, system architecture, and project methodologies, are the intellectual property of EnergyChain. Unauthorized use, reproduction, or redistribution of any content is strictly prohibited.
9. Disclaimers for Wildcat Miners
Wildcat miners must demonstrate that past or current owners waive their legacy ENRC rights to a project, either explicitly or implicitly, to earn ENRC. Projects without clear ownership waiver documentation may be denied.
EnergyChain will apply every available method to assist wildcat miners in complying with project registration requirements, but there are no refunds for denied projects.
10. Amendments
EnergyChain reserves the right to amend these Terms and Conditions at any time. Users will be notified of any changes via the platform, and continued use of the platform constitutes acceptance of the updated terms.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which EnergyChain.ca operates.
